Terms of Service

1. Agreement

By accessing or using AutoPilotYourBrand ("APYB," "Service") at autopilotyourbrand.com, you agree to these Terms of Service ("Terms"). If you use the Service on behalf of an organization, you represent that you can bind that organization.

2. The Service

APYB helps users generate draft social content, review and approve posts, connect social accounts, and publish to supported platforms on a schedule. Features may change as we improve the product. Some capabilities depend on third-party platforms (for example Meta and TikTok) and may be limited by those platforms' policies or availability.

3. Accounts

• You must provide accurate account information
• You are responsible for activity under your account
• Keep credentials and connected social accounts secure; notify us of unauthorized use
• You must be at least 16 years old (or the age of digital consent in your jurisdiction)

4. Your content and platforms

You retain ownership of content you submit. You grant us a limited license to host, process, transmit, and publish that content as needed to operate the Service (including sending it to AI providers for draft generation and to social platforms you connect).

You are solely responsible for content you approve and for complying with Instagram, TikTok, Meta, and other platform terms, advertising rules, and applicable law. We do not guarantee that any post will be accepted or remain available on a third-party platform.

5. Human review

By default, drafts require your approval before publishing. You are responsible for reviewing AI-generated content for accuracy, brand fit, and compliance before approval.

6. Acceptable use

You agree not to:

• Violate law or third-party rights
• Publish spam, malware, or deceptive content via the Service
• Attempt to access accounts or systems without authorization
• Abuse rate limits, reverse engineer, or disrupt the Service
• Use the Service to scrape or harvest data in ways prohibited by platform or legal rules

7. Subscriptions and credits

Paid plans are billed through Stripe according to the tier you select. AI generation may consume credits. Unused credits typically do not roll over unless we expressly say otherwise. Fees are generally non-refundable except where required by law or stated in a specific offer.

We may change pricing with reasonable notice. Continued use after the change takes effect constitutes acceptance.

8. Intellectual property

The Service, including software, branding, and documentation, is owned by AutoPilotYourBrand and its licensors. These Terms do not grant you rights to our trademarks or source code except as needed to use the Service.

9. Third-party services

The Service integrates with third parties (authentication, hosting, AI, payments, and social networks). Their terms and privacy policies apply to your use of those services. We are not responsible for third-party outages, policy changes, or account restrictions.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant uninterrupted or error-free operation, or that AI drafts will be accurate or suitable without review.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, APYB AND ITS OPERATORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, OR DATA. OUR TOTAL LIABILITY FOR CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE CLAIM (OR USD $50 IF YOU HAVE NOT PAID).

12. Indemnity

You will defend and indemnify APYB against claims arising from your content, your use of connected social accounts, or your violation of these Terms or applicable law.

13. Suspension and termination

You may stop using the Service at any time. We may suspend or terminate access for violations of these Terms, risk to the Service, non-payment, or legal reasons. Provisions that by nature should survive (including IP, disclaimers, and liability limits) will survive termination.

14. Changes to the Terms

We may update these Terms by posting a revised version on this page. Material changes may be communicated by email or in-product notice. Continued use after the effective date constitutes acceptance.

15. Governing law

These Terms are governed by the laws of the State of Delaware, USA, excluding conflict-of-law rules, unless mandatory local consumer law applies. Courts in Delaware will have exclusive jurisdiction, subject to applicable consumer protections.
